Course Overview

Effective September 1, 2008 Rule 104.1, licensees may choose to have up to four (4) hours of risk management-related coursework (includes risk management, record keeping, and/or ethics courses and the allowance for self-study hours has been increased to (6) hours. This course is designed to assist the dental practitioner in minimizing their chances of a lawsuit or Dental Board investigation through the use of effective risk management techniques. Dr. Waller will explore how to avoid these setbacks in your dental office.


Objectives

Learn the top three reasons dental offices are at risk for lawsuits.

Understand how the utilization of risk management techniques can dramatically decrease the risk of a lawsuit.

Be able to identify issues in your own practice which will reduce the risk of a Dental Board investigation.

Identify the essential elements which must be in every dental record to allow you to comply with Dental Board Rules.

Learn the steps which must be taken to increase your chances of a favorable outcome in a Dental Board investigation.

Understand the documentation issues which can reduce your exposure from investigations by other State and Federal agencies.

  • Edward P. "Joe" Waller, Jr., DDS, JD
    • EDWARD P. "JOE" WALLER, JR., DDS, JD, received his dental degree from St. Louis University School of Dentistry in 1969 and his law degree from St. Mary’s University School of Law in 1990. He is an attorney with the law firm of Wagner Cario Veale & Zuber LLP in San Antonio, Texas. His practice is focused on the defense of hospitals, physicians, and dentists in medical and dental malpractice lawsuits. Dr. Waller also frequently represents dentists in investigations and hearings before the State Board of Dental Examiners.

No Recording and Transcription Policy
To protect the privacy, security, and integrity of our programs, meetings, and events, recording of any kind is strictly prohibited unless expressly authorized in writing by the department director. This includes, but is not limited to:
- Video recordings (camera, phone, webcam, or other devices)
- Audio recordings (phone, microphone, digital recorders, etc.)
- Screen captures or screen recordings
- AI-based or automated transcription tools (e.g., apps or software that convert speech to text)

Guidelines: All participants are expected to respect this policy at all times. If recording is necessary as an accommodation, or for education or administrative purposes, prior approval must be obtained in writing. Unauthorized recording or transcription may result in removal from the session and/or further administrative action. Exceptions may only be granted by the department director in advance. Taking detailed notes is encouraged, and participants are welcome to take pictures of the presentation slides for personal use.

Purpose: This policy ensures a safe and respectful environment, protects sensitive and proprietary information, and upholds the confidentiality of all participants.
